ADDITIONAL ARTICLE
AFTER ARTICLE 5, insert the following article:
I. - Article L. 3511-3 of the Public Health Code is amended as follows:
a) In the first paragraph, after the reference: "L. 3511-1", are inserted the words: ", electronic vaping devices and associated refill bottles";
b) In 1 °, after the two occurrences of the word: “tobacco”, the words are inserted: “and electronic vaping devices or refill bottles associated with them”;
c) The last paragraph is completed by the words: “electronic vaping devices and associated refill bottles”.
II. - The I comes into force on May 20, 2016.
SUMMARY
Directive n ° 2014/40 / EU of 3 April 2014 relating to tobacco products and related products provides in the fifth point of its article 20 the prohibition in the majority of media (radio, television, internet, press, sponsorship) direct and indirect advertising for electronic vaping devices and associated refill bottles that contain nicotine. Only the support for "display", in that it comes under the sole competence of the Member States, and the supports intended for the professional organizations concerned, in that they are necessary for the exercise of this trade and not have no impact on the general public, are not affected by this European text. In addition, advertising is still permitted inside points of sale.
The purpose of this amendment is to ban advertising for these products in accordance with Directive 2014/40 / EU. However, in order for the device to be consistent, display advertising is added to the advertising media affected by the ban, and the scope of the ban is also extended to electronic vaping devices and refill bottles that do not contain vaping. nicotine.
